Website & eCommerce Services Agreement

Premium eCommerce Starter Package

This Agreement is entered into between TheForgeZA (“Service Provider”) and the Client (“Client”) on acceptance of the package and first payment.

1. Scope of Services

The Service Provider agrees to deliver and manage a WordPress-based eCommerce website in accordance with the Premium eCommerce Starter Package, which includes:

1.1 Website & Hosting

• Domain registration or transfer (subject to availability)

• Secure website hosting with SSL

• Daily backups and uptime monitoring

• SEO-friendly technical setup

1.2 Website Pages

The following pages will be built and structured once at setup:

• Home

• About Us

• Contact Us

• Terms & Conditions

• Returns & Shipping Policy

1.3 Online Store Setup

• WooCommerce installation and configuration

• Up to 25 simple products added at launch, based on information supplied by the Client

• Stock tracking enabled

“Simple products” include one price, no variations, no subscriptions, and no bundles.

1.4 Payments & Shipping

• Configuration of up to three (3) payment gateways

• Bob Go shipping integration and setup

• Checkout tested prior to launch

1.5 Communication Tools

• WhatsApp chat button linked to Client’s number

• Contact form setup

2. Launch Timeline

• Website launch is targeted within 7 working days

• Timeline begins only once all required content, product information, and approvals are received from the Client

• Delays caused by incomplete or late submissions are not the responsibility of the Service Provider

3. Monthly Support & Maintenance

To keep the package affordable, monthly support is capped and structured.

3.1 Included Per Month

• Up to 2 content updates

  • Text edits

  • Price changes

  • Updates to existing products

• Up to 5 support tickets

  • Technical issues

  • Guidance or usage questions

  • Minor configuration support

• Core software, theme, and plugin updates

• Security monitoring

3.2 Support Conditions

• Support is provided during standard business hours

• Tickets do not roll over month-to-month

• Unused updates or tickets expire monthly

4. Exclusions & Additional Work

The following are not included in this package and require separate quotation:

• Adding new products beyond the included limits

• Advanced product types (variations, subscriptions, bundles)

• Custom plugin or feature development

• Marketing, advertising, or SEO campaigns

• Unlimited revisions or daily changes

• Third-party service fees (payment gateways, couriers, etc.)

5. Client Responsibilities

The Client agrees to:

• Supply accurate and complete content, product data, and images

• Maintain legal compliance for products sold

• Respond to requests for approval or clarification promptly

• Keep login credentials secure

The Service Provider is not responsible for incorrect information supplied by the Client.

6. Payments & Billing

• This package is billed monthly in advance

• Services remain active only while the account is in good standing

• Late or missed payments may result in suspension of services

7. Ownership & Access

• The Client owns their website content and data

• The Service Provider retains administrative access for maintenance and support

• Full access may be transferred upon termination, subject to all outstanding fees being settled

8. Termination

• Either party may cancel with 30 days written notice

• Upon cancellation:

  • Hosting and support will be discontinued

  • The Client may request a backup of their website data

• No refunds are issued for partial months

9. Limitation of Liability

The Service Provider will take reasonable care to maintain uptime and security but cannot guarantee uninterrupted service.
Liability is limited to the value of one (1) month’s service fee.

10. Governing Law

This Agreement is governed by the laws of the Republic of South Africa.

11. Acceptance

By purchasing or continuing to use this package, the Client acknowledges that they have read, understood, and agreed to the terms of this Agreement.
