2. SERVICE DESCRIPTION
The Forge ZA provides a managed website solution including hosting, website setup, maintenance, and technical support.
The service operates on a monthly subscription basis and remains active only while payments remain current. The service is provided as a managed platform, not as a standalone website development transfer service.
3. PACKAGE FEATURES
The Print-on-Demand Website Package includes:
Website Infrastructure
- WordPress website installation
- WooCommerce store configuration
- Print-on-Demand designer integration
- Core website pages setup (Home, About, Contact, Policies)
Hosting & Security
- Managed hosting environment
- SSL certificate
- Daily backups
- Security firewall protection
- Malware monitoring
- Website uptime monitoring
eCommerce and Print on Demand Setup
- Up to 10 product types pre-configured
- Payment gateway configuration (up to 3)
- Shipping configuration (example: BobGo or flat rate)
Customer Communication Tools
- WhatsApp chat integration
- Contact form configuration
4. MONTHLY MAINTENANCE & SUPPORT
The monthly fee includes technical maintenance and limited support.
Maintenance includes:
- WordPress core updates
- Plugin updates
- Server monitoring
- Backup management
- Security monitoring
Support includes:
- Up to 4 minor website updates per month
Examples of minor updates:
- 10 x Product price changes
- 10 x Product description edits
- Text edits on existing pages
- Replacement of images
The following are not included in standard support:
- New page design
- Custom plugin development
- Bulk product imports
- Advanced website redesign
- Custom coding
Additional work may be quoted separately.
5. CLIENT RESPONSIBILITIES
The client agrees to provide all required information needed for the website setup. This may include:
- product images
- product pricing
- product descriptions
- payment gateway approvals
- shipping configuration information
- brand assets (logos and colours)
The Forge ZA is not responsible for delays caused by missing or incomplete client information.
The client warrants that all content supplied:
- does not infringe copyright
- does not violate trademarks
- complies with applicable laws.
6. PAYMENT TERMS
Monthly subscription fee: R599 per month
Payment conditions:
- Payment is due monthly in advance
- Services are active only while payments are current
- Late payments beyond 7 days may result in service suspension
The Forge ZA reserves the right to suspend services automatically when invoices remain unpaid. Services may be restored once outstanding balances are settled.
7. CHARGEBACK & PAYMENT DISPUTES
Clients agree not to initiate chargebacks or payment disputes without first attempting to resolve the matter with The Forge ZA.
If a chargeback occurs:
- services may be immediately suspended
- access to hosting infrastructure may be revoked
- additional administrative fees may apply
Fraudulent chargebacks may be pursued through legal recovery processes.
8. DOMAIN REGISTRATION
If The Forge ZA registers the domain name on behalf of the client:
- the domain remains registered for the client
- domain renewal fees may apply annually
- the client is responsible for renewal payments
Failure to renew a domain may result in domain expiration. The Forge ZA is not responsible for domains registered through third-party providers.
9. HOSTING ENVIRONMENT
The website operates on infrastructure managed by The Forge ZA. The hosting environment remains the exclusive property of The Forge ZA. Clients do not receive direct server ownership or server administrative access. The Forge ZA may limit resource usage to maintain server stability.
10. WEBSITE OWNERSHIP
The client retains ownership of:
- website content
- product information
- uploaded images
- brand assets
The Forge ZA retains ownership of:
- hosting infrastructure
- server configurations
- deployment systems
- internal automation frameworks
These systems are proprietary to The Forge ZA.
11. WEBSITE EXPORTS
Upon cancellation, the client may request a basic export of their website content.
Exports may include:
- product data
- images
- text content
Server configurations, plugins, or infrastructure systems are not included in exports.
12. ACCEPTABLE USE POLICY
The client agrees not to use the service to host or distribute:
- illegal products or services
- copyright-infringing material
- malware or malicious scripts
- phishing pages or fraudulent activity
- hate speech or illegal content
The Forge ZA reserves the right to suspend services immediately if such content is detected.
13. THIRD-PARTY SERVICES
The website may integrate with external services including:
- payment gateways
- shipping providers
- external plugins
- cloud services
The Forge ZA is not responsible for outages or failures of third-party services. Changes to third-party platforms may require website adjustments.
14. LIMITATION OF LIABILITY
The Forge ZA shall not be liable for:
- loss of business revenue
- loss of profits
- downtime caused by external providers
- cyberattacks beyond reasonable control
- user-generated errors
- third-party system failures
Total liability is limited to the value of the most recent monthly service fee paid.
15. DATA SECURITY
The Forge ZA implements reasonable security measures including:
- firewall protection
- malware monitoring
- backups
However, no internet service can guarantee absolute security. The client remains responsible for protecting their login credentials.
16. SERVICE SUSPENSION
Services may be suspended if:
- payments are overdue
- illegal content is detected
- the website threatens server stability
- the service is abused
The Forge ZA may suspend services without prior notice in urgent cases.
17. TERMINATION
Either party may terminate this agreement with 30 days written notice.
Upon termination:
- hosting services will be discontinued
- website access may be removed
- data exports may be requested before final termination
18. MODIFICATIONS TO SERVICES
The Forge ZA reserves the right to modify service features, infrastructure, or package offerings as technology evolves. Where possible, clients will be notified of significant changes.
19. GOVERNING LAW
This agreement shall be governed by the laws of South Africa. Any disputes shall fall under the jurisdiction of South African courts in the Western Cape.
20. ACCEPTANCE OF TERMS
By signing this agreement, the client confirms that they have read, understood, and agree to the terms of service.
